Terms of Service
Version 1.0 | February 2026
These Terms of Service govern your use of Gift Aid Boost, a trading name of Phaseglass Ltd (company number 17064980, registered in England and Wales, registered office: 42 Amberley Road, Portsmouth, Hampshire, PO2 0TG). By registering for an account, you agree to be bound by these terms. Please read them carefully.

1. Agreement to Terms
- By creating an account on Gift Aid Boost, you agree to these Terms of Service, our Privacy Policy, and our Data Processing Agreement
- You must be an authorised representative of a UK-registered charity to use this service
- If you do not agree to these terms, you must not use Gift Aid Boost
- These terms constitute a legally binding agreement between you (and the charity you represent) and Gift Aid Boost
2. Eligibility
- Your charity must be registered with the Charity Commission for England and Wales (or equivalent UK regulator)
- Your charity must be registered with HMRC to claim Gift Aid
- You must be authorised by your charity’s trustees to act on their behalf in matters relating to Gift Aid claims
- You must be at least 18 years of age
3. Account Responsibilities
- You must provide accurate and complete information when registering
- You are responsible for maintaining the security of your account credentials, including your password and two-factor authentication
- Each charity may have one account on Gift Aid Boost
- You must notify us immediately of any unauthorised access to your account by contacting james@giftaidboost.com
- You are responsible for all activity that occurs under your account
- We may suspend or terminate your account if we believe it has been compromised
4. Our Services
- Gift Aid Boost provides a platform to help UK charities recover unclaimed Gift Aid by:
- Ingesting and cleaning donor data from your records
- Matching and deduplicating donor information
- Facilitating Gift Aid declarations from donors
- Generating HMRC-compliant Gift Aid schedule spreadsheets for Charities Online submission
- We do not provide tax advice, legal advice, or accounting services
- We are not responsible for the accuracy of data you upload or for HMRC’s decisions on claims
- We use reasonable efforts to maintain service availability, but do not guarantee uninterrupted access
- We may update the platform from time to time to improve functionality and security
5. Your Data Obligations
- You must have a lawful basis under UK GDPR for processing the donor personal data you upload
- You are the data controller for donor data; we act as your data processor
- You must ensure the accuracy of donor data before uploading
- You must comply with your obligations under UK GDPR, including informing donors about how their data will be processed
- You must have a Data Processing Agreement in place with us (accepted during registration)
- You must not upload special category data (as defined in UK GDPR Article 9) to the platform
6. Fees and Payment
- Current pricing is displayed on our pricing page
- Invoices are issued monthly and payable within 45 days. This payment term is designed to give you time to submit your Gift Aid claim to HMRC and receive payment before our invoice falls due — however, the 45-day term applies regardless of whether or when you submit your claim
- Payments are processed securely via Stripe
- We reserve the right to change our pricing with 30 days’ written notice via email
- If payment is overdue beyond the 45-day term, we may suspend access to your account until the balance is settled
- All fees are exclusive of VAT, which will be added where applicable
7. Intellectual Property
- We own all intellectual property rights in the Gift Aid Boost platform, including its design, code, and documentation
- You own all data you upload to the platform — we do not claim any ownership of your donor data
- You grant us a limited licence to process your data solely for the purpose of providing our services
- This licence terminates when your account is closed and data is deleted
8. Acceptable Use
- You must not use Gift Aid Boost for any illegal or unauthorised purpose
- You must not attempt to reverse engineer, decompile, or disassemble any part of the platform
- You must not use automated tools to scrape, crawl, or extract data from the platform
- You must not share your account credentials with unauthorised individuals
- You must not attempt to access other users’ data or accounts
- You must not upload data that contains malware, viruses, or other harmful content
- We reserve the right to suspend or terminate accounts that violate these rules
9. Limitation of Liability
- Our total liability to you for any claims arising from or related to these terms or the service is limited to the fees paid by you in the 12 months preceding the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any losses resulting from:
- HMRC decisions to reject or reduce Gift Aid claims
- Inaccuracies in data you upload to the platform
- Service interruptions caused by circumstances beyond our reasonable control (force majeure)
- Your failure to maintain the security of your account
- Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law
10. Termination
- Either party may terminate this agreement by giving 30 days’ written notice to the other party
- We may terminate your account immediately if you breach these terms
- Upon termination:
- You may request an export of your data within 30 days
- We will delete your personal data within 90 days, except where required for HMRC audit retention (6 years)
- Any outstanding fees remain payable
- Sections 7 (Intellectual Property), 9 (Limitation of Liability), and 12 (Governing Law) survive termination
11. Changes to These Terms
- We may update these terms from time to time
- We will notify you of material changes at least 30 days before they take effect, via email to your registered address
- Continued use of Gift Aid Boost after changes take effect constitutes acceptance of the updated terms
- If you do not agree to updated terms, you may terminate your account before they take effect
12. Governing Law
- These terms are governed by the laws of England and Wales
- Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales
